These Terms of Use form a binding agreement between you and Lucky Summons ("we", "us") about your use of Lucky Summons (the "Game"). By installing or playing the Game you agree to these Terms. If you do not agree, do not install or play the Game.
You must be at least 13 years old, or the minimum age required to consent to data processing in your country, to play the Game. If you are under the age of legal majority where you live, you may only use the Game with the consent of a parent or guardian.
You can play as a guest, or you can sign in with Google or Apple to sync your progress across devices. You are responsible for keeping your sign-in credentials secure and for any activity that happens under your account.
If we have reason to believe your account has been used to violate these Terms, we may suspend or terminate it. We may also terminate or suspend accounts that are inactive for an extended period.
We grant you a personal, non-exclusive, non-transferable, revocable license to install and play the Game for your own non-commercial entertainment, subject to these Terms and the rules of the Apple App Store or Google Play Store (whichever you downloaded the Game from).

The Game offers virtual items, including currencies (gems, war tokens, shards), units, artifacts, energy refills, and other unlocks. These items have no monetary value, are not redeemable for cash or credit outside the Game, and cannot be transferred between accounts or to third parties.
In-app purchases are processed by Apple or Google, depending on the platform you use. All sales are final. Refund requests must go through Apple or Google according to their policies; we do not process refunds directly except as required by law.
We may add, modify, replace, suspend, or remove virtual items at any time. We may also adjust the price or availability of items in the in-game shop. We are not required to compensate you for changes that reduce the value of items already in your account, except as required by law.
We may update the Game from time to time. Some updates are required to continue playing. We may also discontinue the Game, or specific features within it, with reasonable advance notice when practical. We do not guarantee that the Game will be available without interruption or free of errors.
You can choose a username and an avatar inside the Game. By choosing a username you grant us a worldwide, non-exclusive license to display it to other players where the Game shows player names (for example, on leaderboards or activity feeds). You are responsible for the username you choose. We may reject or change usernames that are offensive, infringing, or that impersonate another person or entity.
We own or license all intellectual property in the Game, including the code, art, sound, characters, names, and design. Apart from the limited license in Section 3, no rights in the Game are transferred to you.
Some art used in the Game is licensed from third parties (for example, the "Tiny Swords" asset pack by Pixel Frog). Those assets remain the property of their original authors.
Our handling of your information is described in our Privacy Policy. By playing the Game you also agree to that policy.
The Game is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. To the extent permitted by law, we disclaim all such warranties.
To the maximum extent permitted by law, neither Lucky Summons nor its officers, employees, or contractors will be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Game, including loss of game progress, virtual items, profits, data, or goodwill, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or related to the Game is limited to the greater of (a) the amount you paid us through in-app purchases in the 12 months before the event giving rise to the claim, or (b) 50 US dollars.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. If those laws apply to you, the disclaimers and limits above apply only to the extent permitted.
You may stop playing the Game and delete your account at any time. We may suspend or terminate your access to the Game if you violate these Terms or if we are required to do so by law. On termination, the license in Section 3 ends and Sections 4, 7, 9, 10, 12, and 13 survive.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws rules. You agree that any dispute arising out of or related to the Game or these Terms will be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
Nothing in this section limits any non-waivable rights you have under the laws of your country of residence.
We may update these Terms from time to time. When we make material changes we will update the "Last updated" date at the top of this page and prompt you in the Game to review and accept the new version. If you do not agree to the new Terms, you must stop playing the Game.
